Terms of Use

1. Our role

Parkman Cattle is a venue. We publish listings of live cattle offered for sale by independent sellers and we operate periodic online auctions for consigned lots. We are not the seller of any cattle listed on the Site, we do not own or take possession of the cattle, and we are not a party to any sale between a buyer and a seller. Sales are made directly between the buyer and the seller on terms they agree between themselves.

2. Listings and seller responsibility

Sellers are responsible for the accuracy and completeness of the information they give us for a listing, including head count, breed, age, weight, breeding status, registration, health status, price and location. By submitting a listing you represent that you own the cattle or are authorized to sell them, that the information and photos you provide are accurate and belong to you, and that you consent to your name, location and phone number being published on the listing.

Sellers agree to tell us promptly when listed cattle sell or are withdrawn so the listing can be updated. We may edit, decline or remove any listing at our discretion.

3. Buyer due diligence

Buyers are responsible for their own inspection and evaluation of any cattle before purchase. We encourage every buyer to message us on WhatsApp, ask questions, view the cattle in person where possible, and verify registration papers, pregnancy status, health records and any other claims before agreeing to buy. Prices marked Firm or Negotiable reflect the seller's stated position and are not set or verified by us.

4. Online auctions

From time to time we run online auctions on the Site. The following rules apply to every auction unless the sale terms posted for a specific event say otherwise:

• A bid is a binding commitment to buy the lot at the bid amount if you are the high bidder when the lot closes. Do not bid unless you intend to buy.
• Bids are per head unless the lot states otherwise. Pairs sell as a unit.
• Winning bidders are contacted by phone to confirm the sale. You must provide a working phone number to bid.
• Payment is due within the payment window stated in the sale terms, by wire transfer or certified funds, unless otherwise agreed with us in writing.
• The buyer arranges and pays for transport. Cattle load from the seller's location shown on the lot.
• The seller provides health papers and brand inspection as required for interstate movement to the buyer's destination.
• Auction cattle sell as-is. We may reject, cancel or void any bid we believe was made in error, in bad faith or in violation of these terms.

The sale terms currently posted for the Fall Online Cattle Sale are shown on the auctions page and form part of these terms for that event.

5. Acceptable use

You agree not to use the Site to post false or misleading information, to harvest seller contact details for unsolicited marketing, to interfere with the operation of the Site, or for any unlawful purpose. Seller phone numbers are published so that genuine buyers can contact sellers about the cattle listed.

6. No warranties

The Site and all listings are provided "as is" and "as available". We make no warranty of any kind, express or implied, about the Site, the listings, the cattle, or any seller or buyer, including any warranty of merchantability, fitness for a particular purpose, title, accuracy or non-infringement. We do not guarantee that any listing is current, that any cattle are as described, or that any transaction will be completed.

7. Limitation of liability

To the fullest extent permitted by law, Parkman Cattle Company and its owners, employees and agents will not be liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of profit, livestock, revenue or data, arising out of or related to your use of the Site or any transaction with a seller or buyer, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of the Site will not exceed the amount, if any, you paid us in connection with the matter giving rise to the claim.

8. Indemnity

You agree to indemnify and hold harmless Parkman Cattle Company from any claim, loss or expense, including reasonable attorney's fees, arising from your listings, your bids, your transactions with other users, or your breach of these terms.

9. Governing law

These terms are governed by the laws of the state in which Parkman Cattle Company is organized, without regard to its conflict-of-law rules. Any dispute arising out of these terms or your use of the Site will be brought in the state or federal courts located in that state, and you consent to their jurisdiction.

10. Changes to these terms

We may update these terms from time to time. The effective date at the top of this page shows when they were last changed. Continued use of the Site after a change means you accept the updated terms.
