Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Cattle Hub website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

2. Description of Service

Cattle Hub provides an online marketplace platform that connects cattle ranchers (sellers) with buyers, facilitates the sale of live cattle, and offers a processed beef delivery service ("Butcher Box"). We act as a marketplace facilitator and do not own, raise, or process cattle ourselves except through our Butcher Box service partnerships.

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Seller Requirements

Sellers on Cattle Hub must:

• Complete our verification process, including identity and business documentation
• Maintain all required licenses and permits for livestock sales in their jurisdiction
• Provide accurate and complete information in all listings
• Comply with all applicable federal, state, and local laws regarding livestock sales
• Provide accurate health certificates and documentation for cattle
• Honor agreed-upon prices and terms with buyers

5. Buyer Responsibilities

Buyers on Cattle Hub agree to:

• Conduct due diligence before making purchases
• Comply with all applicable laws regarding livestock ownership and transport
• Make payments in accordance with agreed-upon terms
• Provide accurate shipping and delivery information
• Arrange proper facilities for receiving live cattle when applicable

6. Marketplace Transactions

Cattle Hub facilitates transactions between buyers and sellers but is not a party to these transactions except for Butcher Box orders. For peer-to-peer cattle sales:

• All sales are final unless otherwise agreed between buyer and seller
• Cattle Hub does not guarantee the quality, safety, or legality of listed items
• Buyers and sellers are responsible for resolving disputes directly
• Cattle Hub may assist in dispute resolution but is not obligated to do so

7. Butcher Box Service

For Butcher Box orders:

• Cattle Hub coordinates with partner ranches and USDA-inspected processing facilities
• Orders are subject to our satisfaction guarantee as described in our Returns Policy
• Processing timelines are estimates and may vary based on availability
• Deposits are non-refundable once an animal has been committed for processing
• Custom cut specifications must be submitted within the timeframe specified

8. Fees and Payments

Cattle Hub charges sellers a subscription fee based on their selected plan. We do not charge commissions on cattle sales. All fees are described on our Pricing page and are subject to change with notice. Payments must be made through approved payment methods.

9. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Post false, misleading, or fraudulent listings
• Misrepresent the health, breed, age, or condition of cattle
• Circumvent our verification or safety processes
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Service
• Use automated systems to access the Service without permission
• Interfere with the proper operation of the Service

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Cattle Hub and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you submit but grant us a license to use it in connection with the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATTLE HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Cattle Hub is not responsible for the quality, safety, or legality of cattle listed by sellers, the truth or accuracy of listings, the ability of sellers to sell cattle, or the ability of buyers to pay for cattle.

12. Indemnification

You agree to indemnify and hold harmless Cattle Hub, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Travis County, Texas.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
